Terms of Use

1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of Poldero Apps ("the App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Description of the Service

The App provides a simple daily check-in feature. Users are expected to tap a check-in button once per day. If a check-in is missed, the App triggers an SMS notification to a designated emergency contact. The App is provided as a supportive tool and does not guarantee user safety or emergency response.

3. Eligibility

You must be at least 16 years old (or the minimum legal age in your jurisdiction) to use the App. By using the App, you confirm that you meet this requirement.

4. User Responsibilities

You agree to:

• Provide accurate and up-to-date information (name and phone numbers)
• Ensure your emergency contact has consented to receive SMS notifications
• Use the App only for lawful purposes
• Perform your daily check-in as intended

You acknowledge that failure to check in may result in an SMS being sent to your emergency contact.

5. Emergency Contact Responsibility

You are solely responsible for:

• Selecting an appropriate emergency contact
• Informing them about the App’s functionality
• Obtaining their explicit consent to be contacted

We are not responsible for any consequences arising from contacting your designated emergency contact.

6. No Emergency Service Guarantee

The App is not an emergency service and should not be relied upon as a substitute for emergency services. We do not guarantee:

• Delivery or timeliness of SMS notifications
• Availability of the service at all times
• That your emergency contact will receive or act upon notifications

In case of an emergency, you should contact local emergency services directly.

7. Service Availability

We aim to provide a reliable service but do not guarantee uninterrupted availability. The App may be affected by:

• Network or connectivity issues
• Third-party service failures (e.g., SMS providers)

8. Data and Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your data as described in the Privacy Policy.

9. Limitation of Liability

To the maximum extent permitted by law:

• The App is provided "as is" and "as available"
• We are not liable for any indirect, incidental, or consequential damages
• We are not liable for failure or delay in sending SMS notifications
• We are not liable for any harm resulting from missed check-ins or reliance on the App

10. Indemnification

You agree to indemnify and hold harmless the App provider from any claims, damages, or liabilities arising from:

• Your use of the App
• Your failure to obtain consent from your emergency contact
• Any misuse of the App

11. Modifications to the Service

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, notifying our users within a reasonable amount of time.

12. Updates to Terms

We may update these Terms from time to time. Continued use of the App after changes means you accept the updated Terms.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms. You may stop using the App at any time.

14. Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles. If you are a consumer in the European Union, you may also benefit from mandatory provisions of the law of your country of residence.
